Gordon Scott Staton appeals the district court’s order dismissing his 42 U.S.C. § 1983 (2012) action without prejudice * under 28 U.S.C. § 1915A(b)(2) (2012). We have reviewed the record and find no reversible error. Accordingly, we deny Sta-ton’s motion to appoint counsel and affirm *188for the reasons stated by the district court. Staton v. Virginia, No. 7:14-cv-00622-GEC (W.D.Va. Nov. 26, 2014). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before this court and argument would not aid the decisional process.
