Order of confirmation and report of referee modified by reducing the damages, as found by the referee, to the sum of §393.30,—being the sum of §350 for counsel fees, and the sum of §143.30 for costs and expenses of the" referee; and, as so modified, affirmed, without costs of this appeal to either party.
