The court will order a justice to amend his return by stating the evidence of a former trial for the same cause of action.

On certiorari. Tbe court ruled that if there has been a former trial for tbe same cause of action, and a justice refuse evidence of it, be will be ordered to amend bis return, by setting forth tbe testimony offered.(a)
