STATE of Louisiana ex rel. Charles Wilfred EZEB, Jr. v. Hon. Elmo E. LEAR, Judge, 19th Judicial District Court, State of Louisiana.

No. 58087.

Supreme Court of Louisiana.

June 15, 1976.

In re: Charles Wilfred Ezeb, Jr. applying for Writs of Habeas Corpus and Mandamus.

Writ granted to this extent. It is ordered that a copy of the trial transcript in this court be furnished to relator’s attorney for preparation of appeal. Copy of letter of transmittal shall be furnished to relator.

SUMMERS, J., is of the opinion that this order is improvident and the writ should be denied.

DIXON, J.,

concurs, but is of the opinion that since 3 copies of this record are in this court, it would be simpler for us to send the record to the warden to deliver to the defendant, instead of burdening an attorney in Baton Rouge.
