The People of the State of New York, Respondent, v. Paolo Maida, Appellant.

Judgment of conviction and order reversed and new trial granted. Held, that the court committed prejudicial error in charging the jury that they might find the defendant guilty of perjury if they believed that he testified falsely upon either of three occasions, two of which were not charged in the indictment. All concurred.
