In re FORFEITURE OF ONE 1973 TWIN-ENGINE BEECHCRAFT BARON AIRPLANE, WHITE WITH BLUE STRIPE, MODEL E-55, U.S. REGISTRATION N511BM, SERIAL NO. TE-916, Together With all Tangible and Intangible Personal Property Found Therein.

No. 4-86-2755.

District Court of Appeal of Florida, Fourth District.

April 15, 1987.

Curtis A. Littman of James F. Littman, P.A., Stuart, for petitioner-James D. Holt, as Sheriff of Martin County, Florida.

No brief filed for respondent.

WALDEN, Judge.

We treat this appeal as a petition for common law certiorari. Fla.R.App.R. 9.040(c). We grant the petition and quash the order dated November 4, 1986, which order stayed the civil forfeiture proceeding against an airplane until the outcome of the criminal charges against the owner of the airplane. Rowell v. Smith, 342 So.2d 149, 150 (Fla. 1st DCA 1977), cert. denied, 351 So.2d 408 (Fla.1977).

The petition for certiorari is GRANTED.

ANSTEAD and LETTS, JJ., concur.
