Judgment and order reversed on the exceptions, and a new trial ordered, with costs to abide the event. Held: 1. That the court erred in limiting the defendant’s liability to negligence. 2. That the plaintiff is entitled to recover for such injuries as resulted from defendant's change of the natural course of the stream. =
