We affirm the dismissal of the petition for dissolution of marriage with prejudice. Our affirmance, however, does not preclude the former wife from instituting the appropriate civil or equitable proceeding to determine the rights to the real property located in Key Biscayne, Florida.
Affirmed as modified.
