Ernest JEFFERSON v. MORTON SALT COMPANY.

No. 83-C-0865.

Supreme Court of Louisiana.

June 10, 1983.

PER CURIAM.

The court of appeal is ordered to grant a rehearing in this matter and, after due consideration, to enter an appropriate order including possible remand to the trial court for the taking of additional evidence relative to plaintiffs surgery.

BLANCHE, J., would deny the writ.

LEMMON, J.,

concurs. The only dispute was whether plaintiff had a residual disability from a work related injury. Since the new evidence was obtained before the judgment became definitive, plaintiff is entitled to a remand to the trial court for a hearing and decision, in the light of that evidence, on whether plaintiff is entitled to a new trial.
