Motion to dismiss an appeal from an order of the Appellate Division of the Supreme Court in the second *707judicial department, entered April 10, 1913, which affirmed an order of Special Term dismissing a writ of certiorari to review the proceedings of defendant in dismissing the relator from the position of chief engineer in the bureau of sewers, borough of Queens, city of New York.

The motion was made upon the ground of failure to file the required undertaking.
