458 So. 2d 433

STATE of Florida, Petitioner, v. William Eugene BURRS, Respondent.

No. 84-854.

District Court of Appeal of Florida, Fourth District.

Nov. 14, 1984.

Jim Smith, Atty. Gen., Tallahassee and Joan Fowler Rossin, Asst. Atty. Gen., West Palm Beach, for petitioner.

Richard L. Jorandby, Public Defender, and Allen J. DeWeese, Asst. Public Defender, West Palm Beach, for respondent.

PER CURIAM.

The state appeals a non-final order which suppresses in-court identification of the accused. We treat the appeal as a petition for certiorari, and deny it. See State v. Walker, 429 So.2d 1301 (Fla. 4th DCA 1983).

ANSTEAD, C.J., and GLICKSTEIN and DELL, JJ., concur.
