552 So. 2d 308

Roosevelt HOLMES, Appellant, v. STATE of Florida, Appellee.

No. 89-1612.

District Court of Appeal of Florida, Fifth District.

Nov. 16, 1989.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Colin Campbell, Asst. Atty. Gen., Daytona Beach, for appellant.

James B. Gibson, Public Defender, and Daniel J. Schafer, Asst. Public Defender, Daytona Beach, for appellee.

DAUKSCH, Judge.

This is an appeal from a guidelines departure sentence. Appellant alleges and appellee concedes the sentencing judge erred by departing from the recommended guideline sentence. Even though the parties disagree as to the extent of the error there is a need to resentence to conform to the proper guideline sentence.

SENTENCE QUASHED; REMANDED.

COBB and COWART, JJ., concur.
