OR CERTIORARI.

Williamson sued his own name, as assignee of Simonton and Wood, and declared on a book account.

By the Court.

The action should have been brought in the name of Simonton and Wood. A book account is a chose in action, and cannot be assigned so as to enable the assignee to bring an action in his own name.

Judgment reversed.
