In Illinois, is it all up to the judge whether or not you get alimony?

I'm separated from my wife and getting a divorce in Illinois. Is it the judge's decision whether alimony is allowed?

Hello @CalvinThumser

Yes, in the State of Illinois, if you and your spouse cannot reach an agreement, then the judge assigned to your Illinois divorce case will make the final determination as to whether alimony should be awarded to either spouse. The judge will also determine the amount and duration of the alimony award. In Illinois, judges must follow the Illinois maintenance guidelines when making alimony determinations, unless there is a good reason to deviate from the guidelines. The Illinois maintenance guidelines specify several factors that a judge must consider when determining whether alimony is appropriate, as well as formulas to calculate the amount and duration of any alimony award. Hope this helps!
